Legal practice in the Republic of Latvia

There are two ways how the advocates of the EU member states can practice in the Republic of Latvia.

The first according to the Law on the Bar (Chapter 7 "Activity of the advocates of the EU member states in Latvia", Section 11 "Procedure for registration and professional activity of the advocates of the European Union member states under profession name of their country of residence") is under profession name of their country of residence (the person has received a document certifying his / her registration to use the advocate's profession name by a competent institution of his/her country of residence).

The second according to the Law on the Bar (Chapter 7 "Activity of the advocates of the EU member states in Latvia", Section 12 "The recognition of the professional qualification of the advocate of the EU member state as appropriate for regular activity") is when the professional qualification is recognized as appropriate for regular activity:

  • the person has carried out professional activity in Latvia under the profession name of his / her country of residence for 3 consecutive years and has certified the required knowledge and gained practice in the sphere of Latvian law (he / she is issued a professional qualification recognition certificate) OR
  • the advocate has not operated in Latvia under the profession name of his country of residence for at least 3 years, but he/she submits an application and evidences of the professional qualification and rights admitted in the country of residence and successfully passes the examination of the professional qualification conformity (he / she is issued a professional qualification admission certificate).

The advocates of the EU member states whose professional qualification is recognized as appropriate for regular activity in Latvia have similar entitlement to professional activity and obligations as sworn advocates in Latvia. The advocates of the EU member states who have registered at the Latvian Council of Sworn Advocates with the profession name of their country or residence can participate in civil and administrative cases according to the provisions of the particular procedural laws, however, they are allowed to participate in proceedings of criminal cases only jointly with a sworn advocate of Latvia.

An advocate of the EU member states who wishes to register at the Latvian Council of Sworn Advocates with the profession name of his / her country or residence has to hand in the necessary documents – the certificate verifying the registration by a competent institution of the person's country of residence (the EU member state in which the advocate has acquired an entitlement to use the advocate’s profession name), the application, a copy of the passport, the CV, documents certifying appropriate education, as well as the information specifying the place of practice of a sworn advocate of Latvia which is going to be also the place of practice and the contact address of the advocate of EU in Latvia and the consent of this Latvian advocate for that.  Such applications are reviewed in the meetings of the Latvian Council of Sworn Advocates.

According to the current practice and taking into account Article 124 of the Law on the Bar, all advocates of the EU member states who are registered at the Latvian Council of Sworn Advocates have a place of practice defined together with the Latvian lawyers (the advocate of a EU member state practices in collaboration with individually practicing sworn advocates of Latvia or sworn advocates practicing in law offices). In order to include an advocate of the EU member state in a register, a certain territory of operation of the relevant court to which he / she belongs should be determined. This, in turn, means that the advocate of a EU member state is included in the advocates’ on-call list and, if necessary, should provide legal assistance also in criminal matters (i.e. jointly with an advocate of Latvia).
